Rule 25
Initial order
(1) If it appears from the petition submitted in accordance with the rules that the prisoner has been detained in violation of the law, the court may issue an order in the name of the defendant to set a date for the hearing of the petition and to make a written answer explaining why the prisoner should not be released from prison and to take the prisoner along with him.
(2) Notwithstanding anything contained in sub-rule (1), the Court shall not order the appearance of a prisoner in the following cases:-
(a) If the prisoner appears physically or mentally unsound,
(b) if the prisoner is geographically distant, or
(c) If for any other reason the court does not consider it necessary or appropriate to make the prisoner appear.
(3) If there is no connection between the petition and the person or office made respondent in the petition, the court may not issue a show cause order in relation to such person or office. 16 (4) If it is seen that any other person or office should be treated as a respondent from the petition or the written answer, the court may issue an order to show cause to such person or office as well.
